Terms of Service

These Terms of Service ("Terms") govern your access to and use of TARA Workbench, operated by SecBerg GmbH ("SecBerg"). By signing up or using the service, you agree to these Terms.

1. The service

SecBerg grants you a non-exclusive, non-transferable right to access TARA Workbench for the number of users and programs specified in your subscription. You may not sublicense, resell, or reverse-engineer the service.

2. Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at security@secberg.com if you suspect unauthorized access.

3. Acceptable use

You may not use the service to: (a) upload content you do not have the rights to; (b) attempt to circumvent tenant isolation or access other tenants' data; (c) use automated scraping beyond legitimate API use; or (d) violate any applicable law or regulation.

4. Your data

You own all TARA artifacts, damage scenarios, attack trees, and other content you create in the workbench. SecBerg acts as a data processor on your behalf. We do not claim any license to your content beyond what is necessary to provide the service.

5. Uptime and SLAs

We target 99.5% monthly uptime measured across our monitoring regions. Planned maintenance is excluded. SLA credits (if applicable to your tier) are issued as service credits against future invoices and are your sole remedy for downtime.

6. Payment

Fees are billed annually in advance (or monthly for monthly plans). Taxes are additional where applicable. Invoices unpaid after 30 days may result in service suspension. We do not offer refunds for partial periods.

7. Confidentiality

Each party agrees to keep the other party's non-public information confidential and not to disclose it to third parties without prior written consent, except as required by law or court order.

8. Limitation of liability

To the maximum extent permitted by law, SecBerg's total liability to you for any claim arising from these Terms or the service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

9. Termination

Either party may terminate the subscription at the end of the current billing period with 30 days' notice. SecBerg may terminate immediately for material breach of these Terms. Upon termination, you have 30 days to export your data before it is deleted.

10. Governing law

These Terms are governed by German law. Disputes shall be resolved in the courts of Berlin, Germany. The UN Convention on Contracts for the International Sale of Goods does not apply.
